Conditions

1. Scope

The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity ( § 13 German Civil Code).

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity (Section 14 of the German Civil Code).

2. Contracting parties, conclusion of contract, correction options

The purchase contract is concluded with Elysianne. By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract language, contract text storage

The language(s) available for the conclusion of the contract: German, English

We save the contract text and send you the order data and our general terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.

4. Delivery conditions

Shipping costs are added to the stated product prices. You can find out more about the shipping costs in the offers or the shipping information.

We only deliver by post. Unfortunately, it is not possible to collect the goods yourself. We also deliver to packing stations.

The delivery time is specified separately for each item on the product page. If the delivery time is not specified, our general delivery times apply, which you can read in the shipping information.

Please note that we are not obliged to deliver the ordered goods if we have ordered the goods correctly on our part but have not been delivered correctly or on time (congruent hedging transaction). In addition, we may not assume the risk of procuring the ordered goods. If the shipment tracking shows that your shipment has been delivered but you have not received any goods, contact us within three days of the specified delivery date. In order to take further steps, this deadline must be met. Further information is explained in our FAQs. If your order cannot be delivered several times for reasons that are not our responsibility, acceptance is refused or the shipment is not picked up from the packing station/branch, it will be returned to us. In these cases, it is equivalent to a cancellation. This automatically converts the contract into a reversal. We will refund the items paid for, less any additional costs incurred (e.g. shipping €4.00 to €6.90).

5. Payment

In our shop you can generally use the following payment methods:

Credit card

You provide your credit card details during the ordering process. Your card will be charged immediately after you place your order.

PayPal

In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data and confirm the payment order. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.

Sofort by Klarna

In order to pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order. Your account will be debited immediately after the order has been placed. You will receive further information during the ordering process.

Google Pay

In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.

Apple Pay

In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.

Amazon Pay

In order to pay the invoice amount via the payment service provider Amazon Payments Europe SCA 38 avenue JF Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, identify yourself with your access data and confirm the payment order. The payment transaction will be carried out within one banking day after the order has been placed. A banking day is every working day with the exception of Saturdays, federal public holidays and December 24th and 31st of each year. You will receive further information during the ordering process.

Klarna

In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will find further information in the respective payment option and in the ordering process.

Purchase on account via Klarna

The invoice amount is due 14 days after dispatch of the goods and receipt of the invoice.

Klarna credit card

During the ordering process, you provide your credit card details. Klarna will charge your card immediately after you place your order. There will be no address or credit check.

6. Retention of title

The goods remain our property until full payment.

7. Warranty and guarantees

Applicability of statutory liability for defects

Unless expressly agreed otherwise below, the statutory liability for defects applies.

The following restrictions and shortening of time limits do not apply to claims based on damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health
  • in the event of intentional or grossly negligent breach of duty or malice
  • in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed, or
  • insofar as the scope of application of the Product Liability Act is open.

Restrictions on consumers

When consumers buy used goods, the following applies: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

Warranties and customer service

Information on any additional guarantees that may apply and their exact terms and conditions can be found on the product itself and on special information pages in the online store.

8. Liability

  • We shall always be liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is open.

In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the liability is limited to the amount of damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here . We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Complaints/incorrect delivery

If you have received a damaged or incorrect item, please contact us within three days of the specified delivery date. Prior contact is required for returns. This deadline must be met in order to take further steps. Use our returns portal to register the complaint or incorrect delivery.

11. Transport damage

If you receive goods with obvious transport damage, we ask you to immediately complain about these defects to the deliverer, document the defects with photos and contact us within three days. Failure to do so will mean that we cannot claim the defects from the shipping service provider and you will not receive a refund.

12. Gift vouchers

A correct email address is required to send the gift voucher.

We accept no liability if the gift voucher is lost.

The Elysianne voucher can be used until it is fully redeemed and the credit will neither be paid out nor accrue interest.

If goods purchased with the gift voucher are returned, the purchase price will be credited to the voucher.

By purchasing and/or using the gift voucher, you agree to the terms of use provided to you at the time of purchase.

13. Discount codes

The corresponding discount code can be applied once per customer to a purchase.

Each discount code can only be used once per customer for one purchase and discount codes cannot be combined with each other. Only one discount code can be used per order.

It is not possible to subsequently apply a discount code to an order that has already been completed.

In the event of a return or cancellation, only the discounted purchase price will be refunded. There is no entitlement to a refund of the discount code or the issue of a new discount code
