Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed (Section 13 of the German Civil Code).

An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity (Section 14 of the German Civil Code).

2. Contracting parties, conclusion of contract, correction options

The purchase contract is concluded with Elysianne. By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

3. Contract language, contract text storage

The language(s) available for the conclusion of the contract: German, English

We save the contract text and send you the order details and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible online.

4. Delivery conditions

Shipping costs are added to the stated product prices. Further information on shipping costs can be found in the offers or shipping information.

We only ship by mail. Unfortunately, self-collection of the goods is not possible. We also deliver to parcel stations.

The delivery time is specified separately for each item on the product page. If the delivery time is not specified, our general delivery times apply, which you can find in the shipping information.

Please note that, as an exception, we are not obligated to deliver the ordered goods if we have correctly ordered the goods ourselves but have not been delivered correctly or on time (congruent hedging transaction). Furthermore, we may not assume the risk of procuring the ordered goods. If the shipment tracking indicates that your shipment has been delivered but you have not received any goods, please contact us within three days of the specified delivery date. This deadline must be met in order to take further steps. Further information can be found in our FAQs. If your order cannot be delivered several times for reasons beyond our control, if acceptance is refused, or if the shipment is not picked up from the packing station/branch, it will be returned to us. In these cases, it is equivalent to a cancellation. This automatically converts the contract into a reversal. We will refund the paid items, less any additional costs incurred (e.g., shipping costs of €4.00 to €6.90).

5. Payment

In our shop you can generally use the following payment methods:

credit card

During the ordering process, you enter your credit card details. Your card will be charged immediately after you place your order.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed by PayPal immediately after you place your order. Further information will be provided during the ordering process.

Sofort by Klarna

To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account activated for online banking, verify your identity, and confirm the payment order. Your account will be debited immediately after you place your order. Further information will be provided during the ordering process.

Google Pay

To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be processed immediately after placing the order. Further information will be provided during the ordering process.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay feature, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction will be processed immediately after placing your order. Further information will be provided during the ordering process.

Amazon Pay

To pay the invoice amount via the payment service provider Amazon Payments Europe SCA, 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed within one banking day after placing the order. A banking day is every working day, except for Saturdays, federal public holidays, and December 24th and 31st of each year. Further information will be provided during the ordering process.

Klarna

In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information can be found in the respective payment option and during the ordering process.

Purchase on account via Klarna

The invoice amount is due 14 days after dispatch of the goods and receipt of the invoice.

Klarna credit card

During the ordering process, you enter your credit card details. Klarna will charge your card immediately after you place your order. An address or credit check is not performed.

6. Retention of title

The goods remain our property until full payment has been made.

7. Warranty and guarantees

Applicability of statutory liability for defects

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.

The following limitations and shortening of time limits do not apply to claims based on damages caused by us, our legal representatives or vicarious agents

  • in case of injury to life, body or health
  • in the event of intentional or grossly negligent breach of duty and fraudulent intent
  • in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed, or
  • insofar as the scope of application of the Product Liability Act is open.

Restrictions on consumers

When purchasing used goods by consumers, the following applies: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

Guarantees and customer service

Information on any additional warranties that may apply and their exact terms and conditions can be found with the product and on specific information pages in the online store.

8. Liability

  • For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is open.

In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the damage foreseeable at the time the contract was concluded and which must typically be expected to occur.

Otherwise, claims for damages are excluded.

9. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here . We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Complaints/Incorrect delivery

If you have received a damaged or incorrect item, please contact us within three days of the stated delivery date. Prior contact is required for returns. This deadline must be met in order to take further steps. Use our returns portal to report the complaint or incorrect delivery.

11. Transport damage

If you receive goods with obvious transport damage, we ask you to immediately report these defects to the delivery company, document the defects with photos, and contact us within three days. Failure to do so will result in us being unable to claim the defects from the shipping service provider, and you will not receive a refund.

12. Gift vouchers

A correct email address is required to send the gift voucher.

We assume no liability for loss of the gift voucher.

The Elysianne voucher can be used until it is fully redeemed and the balance will not be paid out or accrue interest.

If you return goods purchased with a gift voucher, the purchase price will be credited to the voucher.

By purchasing and/or using the gift voucher, you agree to the terms of use provided to you at the time of purchase.

13. Discount codes

The corresponding discount code can be applied once per customer to a purchase.

Each discount code can only be used once per customer for a single purchase, and discount codes cannot be combined. Only one discount code can be used per order.

It is not possible to subsequently apply a discount code to an order that has already been completed.

In the event of a return or cancellation, only the discounted purchase price will be refunded. There is no entitlement to a refund of the discount code or the issuance of a new discount code.
